Event Terms & Conditions

Please read these Terms and Conditions carefully before registering for any Offscript Golf Club event.

By clicking the checkbox that is presented to you in relation to these Terms and Conditions, you indicate your acceptance and the acceptance of any participants you are registering of these Terms and Conditions.

"Offscript" and "we" in this contract refers to Offscript Golf Club, and more broadly SwingPass Inc., and any of its owners, officers, affiliates, directors, agents, and employees.

Facility Use Policies

  1. You assume personal responsibility for any and all damages you cause to the property hosting the event, including, but not limited to, the course itself, course facilities (clubhouse, pro shop, bathroom, dining room, bar, etc.), course equipment (carts, push carts), and parking facilities. You will be responsible for any costs or expenses associated with damage you cause to the property.
  2. You agree to abide by all facility-specific policies set forth by the golf facility hosting the Offscript event.
  3. You agree to release owners of the golf facility, and their employees or agents, from any liability for injury to you or your property resulting from the operation of the cart, except due to the extent caused by the negligence of the releases.
  4. If play is not possible on the date scheduled (as determined by the golf facility hosting the event), we will do everything possible to schedule a rain date. However, if the course is open, deemed playable, and carts are available, the outing is expected to play.

Cheating

  1. The event organizers reserve the right to disqualify, suspend, or remove any participant who violates event rules, behaves unsafely, or engages in conduct deemed unsportsmanlike or detrimental to the spirit of the event, without refund or recourse.

Injury

  1. You voluntarily assume all risk and danger of property loss and personal injury incidental to the game of golf and related activities at the course, including specifically (but not exclusively) those relating to the structure and conditions of the golf facility and equipment, and the danger of being injured by flying objects including clubs and golf balls. To the extent permitted by law, you irrevocably waive all claims of any nature against Offscript, and release and discharge Offscript from all claims, liability, costs, expenses, damages or losses (whether direct or consequential and whether arising under statute, from negligence, personal injury, death, property damage or otherwise) arising from or in connection with this event or any service provided or anything sold at the event, notwithstanding that it may have been caused by the negligent act or omission on the part of Offscript.
  2. You release owners of the golf facility hosting the event, Offscript, and any of either of their subsidiaries, affiliates, officers, directors, agents, and employees from any liability related to personal injury that occurs during an Offscript event.

Grant of Rights

  1. Any photos or video you are featured in that are taken during an Offscript event by Offscript may be used for website content, social media content, advertising, and any other forms of photo/video use related to promoting Offscript as a business. No compensation will be paid with respect to Offscript's use of aforementioned photos.
  2. You agree to receive marketing emails and/or marketing text messages from Offscript. You may opt out of these emails at any time by using the unsubscribe button within the emails and you may opt out of these text messages by replying to the message accordingly.

Indemnity

  1. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE, INDEMNIFY, AND HOLD HARMLESS OFFSCRIPT, ITS SUBSIDIARIES OR AFFILIATED ENTITIES, AND EACH OF OFFSCRIPT'S RESPECTIVE OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, CONSULTANTS, CONTRACT EMPLOYEES, REPRESENTATIVES AND AGENTS, AND EACH OF THEIR RESPECTIVE SUCCESSORS AND ASSIGNS, FROM ANY AND ALL RESPONSIBILITY, CLAIMS, ACTIONS, SUITS, PROCEDURES, COSTS, EXPENSES, DAMAGES AND LIABILITIES ARISING OUT OF OR IN ANY WAY RELATED TO YOUR PARTICIPATION IN AN OFFSCRIPT EVENT OR USE OF THE GOLF FACILITY HOSTING THE EVENT INCLUDING BUT NOT LIMITED TO WITH RESPECT TO BODILY INJURY, PHYSICAL HARM, LOSS, ILLNESS, DEATH OR PROPERTY DAMAGE.
  2. You agree to defend, indemnify, and hold Offscript and its subsidiaries, affiliates, officers, directors, agents, and employees harmless from any liability to third parties, including reasonable attorneys' fees, arising from or related to (i) Your breach of this Agreement, (ii) any personal injury to you that occurs during an Offscript event, and (iii) claims by any Customer relating to any Offscript product or service.
